6. User Content

You retain ownership of any content you submit, upload, or transmit through our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, and process your content solely for the purpose of providing and improving our Services.

You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not infringe upon the rights of any third party.

7. Payment and Billing

Certain Services may require payment. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing with reasonable notice. Continued use of paid Services after a price change constitutes your acceptance of the new pricing.

Our total liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

You agree to indemnify, defend, and hold harmless Moonwind and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Moonwind is incorporated, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services following any changes indicates your acceptance of the new Terms.
